Article 1 - General

These General Terms and Conditions (GTC), concluded between Sorry We Are French and the customer, apply to all sales made on boutique.sorryweare.fr. They determine the rights and obligations of each party in the context of a sale.

When an order is made, the consumer declares to have acknowledged the present Terms and Conditions and accepted it unreservedly.

Sorry We Are French reserves the right to modify, at any time and without notice, these Terms. For all orders placed before any modification, will then be considered the Terms and conditions in effect at the time of checkout. 

Article 2 - Characteristics of a product

A product remains the exclusive property of Sorry We Are French until full payment is received.

Article 2 .1 - About the products

Characteristics of each product offered for sale are available on boutique.sorryweare.fr. They are indicated in the product description with photos or illustrations. These photos are exhibited exclusively for guidance, therefore, their colors or proportions could differ from the actual product. 

Article 2 .2 - Product availability

Sorry We Are French undertakes to fulfill orders received according to stock availability. In the event of inventory shortages products are indicated unavailable on boutique.sorryweare.fr. Customers can track the progress of replenishment by filling their email in the appropriate field. No pre-order is available since some products may not be offered twice on the website. 

Article 3 - Price 

The price charged for each product is the price in force at the time the order is placed. It is indicated in euro, taxes included. The taxes correspond in percentage to the VAT applicable at the time of the execution of the order. Shipping cost, added at checkout, varies according to the value of the order as well as the delivery address (see shipping costs).

Article 3 .1 - For orders outside the European Union or overseas territories 

For products shipped outside the European Union or to overseas territories, prices are charged without added tax. Some authorities may require customs duties or local taxes. These additional charges fall outwith Sorry We Are French’s responsibility and have to be taken care by the customer. It is therefore recommended to him that he obtains in advance information from his local authorities. 

Article 4 - Order

An order can be placed exclusively on a customer account. A customer can create an account at any time by providing his email address to which it will associate a username and personal password.

Section 4.1 - Order Confirmation

Once an order placed, a confirmation email containing all the essential information is sent to the customer. This email is an order confirmation and not an invoice. A copy of the invoice is available on the customer account once the order shipped. 

Article 4.2 - Unavailability of the product

Sorry We Are French ensures to regularly update the inventory on its website. However, the availability of a product can vary quickly based on sales. If an ordered product turns out to be out of stock, the order will be canceled and refunded. The customer will be notified by email and no refund penalty will be applied for such cancellation. 

Article 4.3 - Invoice and order history

The customer account keeps records of the past and current orders. It also contains the invoice of each order, available for consultation and printable.

Article 5 - Methods of payment

Article 5.1 - Payment

Orders can be paid by credit card or wire transfer. For credit card transactions, a secure payment system is used. The information needed for a wire transfer is provided in the customer account. Any additional costs associated with the transaction shall be at the customer’s expense. 

Article 5.2 - Payment date

The payment information is specified by the customer throughout the purchase confirmation. The payment is then collected during the processing and shipment of the order. 

Article 5.3 - Payment refusal

If full payment is not received due to a refusal from the bank or any other cause, the order is canceled and therefore not shipped. It is then up to the customer to contact his bank or to use another method of payment. 

Article 6 - Delivery

Article 6.1 - Delivery schedule

An order is delivered to the address specified by the customer. It is shipped Monday through Friday. 

Article 6.2 - Delivery Method

Orders sent to metropolitan France are delivered by Mondial Relay, Colissimo or TNT, at home or to postal relay. The customer can choose his preferred method during the order confirmation process. For abroad deliveries are used UPS, Chronopost or Colissimo depending on the destination.

Article 6.3 - Tracking

Every order’s delivery can be tracked electronically via a link indicated in the customer account. A tracking number is emailed to the customer once the order is shipped.  

Article 7 - Product Compliance

All products sold on boutique.sorryweare.fr, except if explicitly stated, are brand new. In the event that a non-compliant product would be shipped (defective or missing piece) please contact Sorry We Are French at the following address as soon as possible: contact@sorryweare.fr   

Article 8 - For the professionals 

Is considered professional a customer buying on behalf of the company he represents. Sales made for professional purposes are exclusively dedicated to redistribution.  

Article 8.1 - Professional Account

In order for Sorry We Are French to distinguish individual customers from professionals a “professional” option is offered when registering to a new customer account. 

Article 8.2 - Price

A professional account allows the customer to obtain preferential prices on products. These are indicated in euros and excluding taxes (to check). Once the customer is logged into his account, discount prices are directly displayed in the products descriptions. 

Article 8.3 - Payment 

The methods of payment are the same as those introduced above in section 5.1.

Article 9 - Intellectual Property

Texts, comments, photos, illustrations and logos featuring on boutique.sorryweare.fr are the exclusive property of Sorry We Are French. They are protected by copyright. Therefore, any reproduction, modification, total or partial use of the website, without the written agreement of Sorry We Are French, is strictly prohibited.   

Article 10 - Applicable Law

These General Terms and Conditions is a contract signed between the customer and Sorry We Are French. All clauses and sales referred on this page are legally binding under the French law. In case of a dispute between parties, the grant of jurisdiction will be given to the appropriate French courts. 

Article 11 - Data Protection

As defined in the French Data protection act (Loi “informatique et libertés”), your personal data gathered on boutique.sorryweare.fr is intended for the exclusive use of Sorry We Are French. This data is collected in order to inform you of the availability of our products as well as the processing and monitoring of your orders. According to Article 34 of 6 January 1978, you have the right, at anytime, to access, modify, rectify and delete your data.
